Hiring Foreign Employees

 

  1. Obtaining quotas for issuing invitations to foreign citizens from countries subject to visa requirements

1.1. Under Article 18 of Federal Law ФЗ No. 115 Invitation to the Russian Federation to a Foreign Citizen for Work Purposes, “A quota of invitations to the Russian Federation for foreign citizens, except those who arrived in the Russian Federation under a visa-free procedure, for work purposes shall be approved annually by the Government of the Russian Federation on the basis of proposals from the executive bodies of the constituent entities of the Russian Federation with due regard for the demographic situation in a particular constituent entity and its capabilities to accommodate foreign citizens.”

1.2. To complete and file documents for obtaining quotas, the Department of International Affairs (hereinafter referred to as DIA) shall be notified by academic units / branches of the Vernadsky CFU about the need to invite a foreign citizen in advance, normally no later than April 1 of the current year to obtain quotas for the following calendar year.

The information obtained as a result of submission of documents for quotas can serve as the basis for submission of a new set of documents to adjust / increase quotas. However, the term of allocation of quotas in this case is not defined.

 

  1. Issuing invitations to foreign citizens from countries subject to visa requirements

2.1. According to the current legislation, the University may apply to the Department of the Ministry of Internal Affairs in Simferopol for invitations to foreign citizens from countries subject to visa requirements. Invitations to foreign citizens are issued by the Department of the Ministry of Internal Affairs in Simferopol in accordance with the applicable law. The interaction between the University and the Department of the Ministry of Internal Affairs in Simferopol is maintained through International Centers of academic units / branches or persons in charge of international activities appointed by the academic units / branches / DIA of the Vernadsky CFU.

2.2. To invite a foreign citizen, International Centers of academic units / branches or persons in charge of international activities appointed by the academic units / branches / DIA of the Vernadsky CFU submit to the Department of the Ministry of Internal Affairs in Simferopol:

  1. a) completed internal application form;
  2. b) readable photocopy of all non-blank pages of the valid passport and a written statement (in the form of an internal note) of the reasons for the foreign citizen to enter the Russian Federation at the invitation of the Vernadsky CFU;
  3. c) standard-form request by the host institution;
  4. d) standard-form letter of guarantee;
  5. e) to invite a foreign citizen to the University for teaching, studying, or other academic engagements, an agreement between a foreign citizen and the University is required to be submitted;
  6. f) invitation fee payment receipt.

2.3. The period of issuing the invitation by the Department of the Ministry of Internal Affairs in Simferopol shall not be less than 20 working days. All documents must be submitted no later than 2 months prior to the planned date of entry. International Centers of academic units / branches or persons in charge of international activities appointed by the academic units / branches / DIA of the Vernadsky CFU notify the inviting academic unit/branch about the acceptance of set of documents for processing within 3 days.

2.4. International Centers of academic units / branches or persons in charge of international activities appointed by the academic units / branches / DIA of the Vernadsky CFU shall not be liable for any refusal of invitation letter/visa, change of purpose of travel or visa validity term made by a consular office of the Russian Federation based on an interview results or decision of a consular officer.

 

  1. Notification of arrival of and entering into an agreement with foreign citizens from countries subject to visa requirements

3.1. Foreign citizens arriving to the Russian Federation for teaching, studying, or other academic engagements at the Vernadsky CFU must enter the country only under the University’s invitation letter and a visa for the following purposes as set out in the Directive of the Ministry of Foreign Affairs of the Russian Federation and the Federal Security Service of the Russian Federation No. 19723А/1048/922 dated December 27, 2003:

– “Business” – stay for the purpose of participation in important negotiations (meetings, consultations, conferences, etc.), as well as professional development;

– “Lecturer” – stay for the purpose of giving lectures;

– “Postgraduate Studies” – stay for the purpose of undertaking postgraduate studies;

– “Secondment” – stay for the purpose of professional development or retraining;

– “Courses” – stay for the purpose of undertaking Russian Language courses, University Admission Preparation courses;

– “Study” – stay for the purpose of undertaking university/college/vocational studies (except military educational institutions);

– “Teacher” – stay for the purpose of teaching;

– “Sports Exchange” – stay for the purpose of cooperation in sports;

– “Youth Exchange” – stay for the purpose of youth and student exchanges;

– “Cultural Exchange” – stay for the purpose of cooperation in culture;

– “Scientific and Technical Cooperation” – stay for the purpose of scientific and technical cooperation;

– “Accompanying Family Member” – stay as a family member with a foreign citizen.

Activities of foreign citizens who enter the country at the invitation of the Vernadsky CFU must comply with the purpose of stay specified in the visa.

3.2. According to the current legislation of the Russian Federation, foreign citizens who arrived at the invitation of the Vernadsky CFU must notify the Department of the Ministry of Internal Affairs in Simferopol about their place of residence within seven working days from the day of arrival by registering with the territorial office of the Federal Migration Service.

3.3. Employment / Student Contracts between the University and foreign citizens shall be drafted by the appropriate academic unit of the Vernadsky CFU which shall estimate study/work load, remuneration, services costs and period, etc. The academic unit of the Vernadsky CFU shall receive a prior consent from the Finance and Planning Department and Department of Legal and Human Resource Affairs to the need to invite a foreign citizen and existing financial capability within the staff costs budget. The contract shall be signed by the University’s senior officials and the foreign citizen only after the contract approval cover sheet is completed. Originals of all contract documents and annexes thereto shall be retained by Human Resources Department of the Vernadsky CFU’s academic unit/branch within the foreign citizen’s personal file. If required, one Russian or English (or any other language, as agreed with the foreign citizen) original copy is returned to the foreign citizen.

3.4. All costs of hosting foreign citizens shall be borne by the host academic unit of the University.

 

Stay of foreign citizens at the university

  1. Foreign citizens must reside at the address they are registered at. In case of change in place of residence, foreign citizens must notify, in advance, International Centers of academic units / branches or persons in charge of international activities appointed by the academic units / branches / DIA of the Vernadsky CFU and get re-registered at the new address. All travels within the country must be notified in advance and in writing to the Vernadsky CFU; it is desirable that the foreign citizen has a travelling companion.
  2. According to the Regulations on Mandatory Health Insurance, foreign lecturers are required to have a health insurance policy valid on the territory of the Russian Federation. If a foreign citizen refuses, for some reason, to purchase the policy or has a valid foreign health insurance policy, they shall refuse in writing to purchase the policy and agree to bear all medical care costs during their stay in Russia. In this case, the host side is not responsible for the provision of medical care to the foreign citizen.
  3. Allocation of places in student residence halls of the Vernadsky CFU to foreign citizens must be approved by the Division of Student Residence Halls and reported to the DIA of the Vernadsky CFU. Places in student residence halls are allocated by the prior approval of the residence hall office based on the application submitted by the inviting academic unit and availability of places in residence halls. The residence hall rules and regulations are established in accordance with the applicable laws and documents approved by Directive of the Rector No. 197 dated April 26, 2015. All foreign citizens residing in residence halls must be made aware of the content of these laws and documents, which must be properly documented in the register of the residence hall’s head.
  4. Foreign citizens have the right to contact International Centers of academic units / branches or persons in charge of international activities appointed by the academic units / branches / DIA of the Vernadsky CFU on any matter of interest or concern, both verbally and in writing.

 

 

Departure of foreign citizens and registration of the results of their stay at the University

  1. If foreign students of lecturers need to leave, temporarily or permanently, the Russian Federation, they must notify International Centers of academic units / branches or persons in charge of international activities appointed by the academic units / branches / DIA of the Vernadsky CFU: at least 2 months prior to the date on which they intend to leave the country – in case they can’t leave the country under their visas; at least 10 working days prior to the date on which they intend to leave the country – in case they can leave the country under their visas.
  2. DIA of the Vernadsky CFU has the right to request the academic units / branches of the Vernadsky CFU to provide information which regulates their international activities, including information on foreign lecturers teaching or intending to teach at the University, as well as information on cooperation with foreign partners and holding international events.
